Massachusetts Voters to Weigh Zoning Rules for Lots of at Least 5,000 Square Feet

Image: TokenPost

Massachusetts voters will decide Nov. 3 whether communities covered by the state’s zoning law must allow certain single-family homes on qualifying lots, a ballot measure that would limit local barriers without requiring construction. Question 7 applies to residentially zoned lots of at least 5,000 square feet, with at least 50 feet of frontage along the facing public way and access to public water and sewer. It would bar local zoning from prohibiting a qualifying home or unreasonably restricting it, and from requiring a special permit or other discretionary zoning approval. The proposal sets no upper limit on lot size. Cities and towns could continue to set reasonable standards for building height, setbacks, distance between buildings, open space, parking and short-term rentals.
